SALE AGREEMENT

 

 

This SALE AGREEMENT is made at Islamabad on this ——day of ————–, 202. Between Mr.————————————– S/O——————————-, resident of——————————————————————-, holding N.I.C. No.—————————————————— (hereinafter called the first party-SELLER) which expression where the context so admits shall include and mean his heirs, successors-in-interest, legal representatives and assignees, of the ONE PART:

 

AND

 

Mr. ——————————————– S/O ———————————–, of M/S ——————————————————————Islamabad (hereinafter called the second party-PURCHASER) which expression where the context so admits shall include and mean his heirs successors-in-interest, legal representatives and assignees, of the other part, whereby agreed as under: -

 

Whereas the SELLER is absolute alottee / owner of House/Plot No. ——, situated at Street No. ————–, Sector———————, Islamabad, measuring —————— = ———-sq. yds. , Allotted vide allotment letter No. —————————- dated ——– bounded as follows:

 

NORTH BY: ————————————————-

SOUTH BY: ————————————————-

EAST BY: ————————————————-

WEST BY: ————————————————-

 

The House/Plot mentioned above is free from all sorts of encumbrances and if there are any dues outstanding against the said House/Plot the same shall be paid by the SELLER.

 

And whereas the SELLER has sold the House/Plot and the PURCHASER has also purchased in consideration of Rs. ——————————- (Rupees ———————————————————-) and the SELLER has received the full and final price a sum of Rs. ————————————– (Rupees ————————————————-) from the PURCHASER as follows:

 

(a)         Rs. ——————————- (Rupees ————————————————only) through Pay-Order No. ————————————- dated  ————————— drawn on —————————————.

 

(b)         Rs. ——————————- (Rupees ————————————————only) through Pay-order No.  ————————————- dated  ————————— drawn on —————————————.

(c)         Rs. ——————————- (Rupees————————————————only) through Pay-order No.  ————————————- dated  ————————— drawn on —————————————.

 

 

And now there is nothing outstanding against the PURCHASER towards the said House/Plot and the SELLER.

 

And that the SELLER has handed over the possession of the said House/Plot to the PURCHASER along with its relevant documents.

 

The SELLER has executed the General Power of Attorney with regard to the said Plot/House in favor of Mr. ——————————– S/O Mr. ————————————–. The SELLER is responsible to get transferred the said Plot/House in favor of PURCHASER or his nominee (s), immediately as and when desired by the PURCHASER without any delay.

 

And that the SELLER is not authorized to revoke/cancel or amend the above mentioned Deed of General Power of Attorney, executed today in favor of Mr. ————————————————— S/O Mr.——————————————–, without the prior written consent of the PURCHASER, at any time or at any stage.

 

And that all prior dues of the said Plot/House, if any, will be paid/cleared by the SELLER and transfer fee of the said Plot/House will be paid by the PURCHASER.

 

And that the SELLER has also agreed, that the PURCHASER is at liberty to get the said Plot/House transferred in favor or in favor of any other person(s) desired by him.

 

And that if the SELLER does not comply with all/any clauses of this agreement or cancel, revoke or amend the above Deed of General Power of Attorney or fails to get transferred the said Plot/House in favor of the PURCHASER or his nominee (s), then the SELLER will be responsible to pay double cost of construction of house to the PURCHASER immediately and in this case the PURCHASER will also be competent to get transferred the said Plot/House from the SELLER by force through the court of law on risk and cost of the SELLER and objection by the SELLER will not be considered.

 

And that if the SELLER fails to comply with any or all clauses of this agreement the SELLER shall pay double amount of Rs. ———————————– (Rupees ———————————– only), along with the amount already received i.e. Rs. ———————– (Rupees ———————————— only), to the PURCHASER immediately without any delay whatsoever.

 

And that both the parties and their heirs, successors-in-interest, legal representatives and assignees are bound to complete this deal and no one cancels the same.

 

 

 

 

CONTD: P-3

 

AND THAT THE SELLER HEREBY ASSURES THE PURCHASER: -

 

 

a)      That the SELLER has not taken any loan against the said Plot from any person, Bank or co-operative society nor does any liability exists against the said Plot.

 

b)      That the SELLER has not stood surety or guarantor of any person or organization in respect of any bail or loan any co-operative bank or organization in respect of any form or manner against the said Plot.

 

c)      That at the time of transfer of the said Plot in favor of the PURCHASER or any of his/her nominee (s), the SELLER will appear before the authorities concerned and will get the plot transferred and will also fulfill all the requisite formalities in this respect if rules and regulations change and the power of attorney does not fulfill the purpose.

 

d)     That the SELLER and his her all heirs shall have no claim in interest left in respect of the said Plot with immediate effect.

 

e)      That the SELLER has not entered into any deal overtly or / and covertly with any third party in respect of the said Plot.

 

AND THAT both the parties and their heirs, successors-in-interest, legal representatives and assignees are bound to complete this deal and no one cancels or revoke this sale at any time.

 

IN WITNESS WHEREOF both the parties have set their hands and have signed this Agreement on the date, month and year first mentioned above.
